No! Under the Federal Bill Emerson Good Samaritan Food Donation Act and the California Good Samaritan Food Donation Act, food donors are protected from liability for the food they donate so long as they donate their food to a nonprofit organization in good faith. These laws were implemented in order to improve the quality of the food that people experiencing food insecurity consume, and have generally provided broad protection to donors.
